This web site is owned & operated by Colin Cooper Photography (We, Us, Our, the Photographer).  By using this website you (the Client) hereby agree to the following Terms & Conditions & use the website for lawful purposes only & not use the website in any way that may be deemed fraudulent or unlawful or in any way that might damage the business or reputation of Colin Cooper Photography.

We reserve the right to refuse access to any area of this website, edit or remove products, or cancel orders at our discretion for any reason.  Any cancelled orders will not incur any cost to you.

Materials contained on this website are subject to copyright.  All images contained on this website are the property of Colin Cooper Photography at all times throughout the world.  Images may not be downloaded, reproduced, copied, stored, modified or used in any way without express written permission.

In some cases we may have permission to use images not property of Colin Cooper Photography for this web site.

All transactions made on this site are on the understanding that you agree to our Terms & Conditions.  Please view our full Purchasing Policy for more details.

  • Purchasing

All prices on this site are quoted in UK pounds (£) & are inclusive of VAT.  If applicable, delivery charges will be charged at the checkout.

Payment for any services or products will be expected for the within 14 days of purchase or issue of relevant invoice.

  • Processing & Delivery

Every order is processed individually there we ask you to allow for 10-14 days for your order to be despatched.  Processing times depend on stock & availability.  If for any reason there is a delay, we will contact you to advise.  Delivery times may vary & where multiple items are purchased, these will be held in reserve until your order is complete & despatched as one package.  An additional surcharge will apply for international shipping (out-with the UK).  Any over seas delivery charges may be quoted on request & remains subject to change, to reflect current value.  Only mounted prints will be shipped internationally due to excessive charges for glass & the high risk of damage in transit.

  • Delivery

If in the unlikely event your order is lost please contact us quoting your order number & we will attempt to trace your order for you.

  • Returns

If for any reason you are unsatisfied with your product you have the right to return the item within 7 days of receiving your order.  It is your responsibility to contact us as soon as you notice any problem with your order within a week of receipt.  You will be offered a replacement product or a full refund upon receipt of the returned item.  Items should be returned in as-new condition.  You are responsible for the cost & risk of loss & damage of returned items.  Replacement products or refunds will not be made until we have received the returned items.

  • License of Use

When entering a license of use you agree to the terms stated in the License Agreement.  Copyright to all images licensed remains with the Photographer.  When the License of Use has expired you agree to renew the License Agreement or cease usage of all affected images.

We retain the right in all cases to use any images produced under contract in any manner at any time & in any part of the world for the purposes of advertising or otherwise promoting our work.

The License Agreement does not give you (the client) the right to distribute any images or property to third parties.

  • Right to a Credit

If ‘Right to a Credit’ has been indicated the Photographer’s name will be printed on or in a reasonable proximity to all published reproductions of the Photograph(s) By indicating ‘Right to a Credit,’ the Photographer also asserts his/her statutory right to be identified in the circumstances set out in Sections 77-79 of the Copyright Designs & Patents Act 1988 or any amendment or re-enactment there-of.

  • Payment

Payment for any services or products will be expected for the within 14 days of the issue of relevant invoice.  No use of the Photographs may be made until the invoice is paid in full.

  • Expenses

Where extra expenses or time incurred during commission as a result of alterations to the original brief on behalf of the client, or otherwise at their request, you (the client) shall give approval & be liable to pay such extra expenses or fees at the Photographer’s normal rate to the Photographer in addition to the expenses previously agreed or established in the original brief.

  • Rejection

Unless a rejection fee has been agreed in advance, there is no right to reject on the basis of style or composition or colour grading.

  • Cancellation & Postponement

A booking is considered firm as from the date of confirmation.  A fee will be charged as a result of cancellation or postponement.

  • Events beyond Our reasonable Control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause, which is beyond our reasonable control.

  • Legal

All issues regarding this website & Colin Cooper Photography shall be governed by the laws of Scotland.

  • Liability

Colin Cooper Photography has taken reasonable care to ensure that the information on this website is accurate & up to date, yet it is possible that the information may be out of date, incomplete or the opinion of the author.  It is advisable that you verify any information from this website before relying on it.

Colin Cooper Photography accepts no responsibility for the consequences of error or for any loss or damage suffered by users of any of the information & material contained on this website.
